TERMS AND CONDTIONS OF PORTAL AND ONLINE LEASING SERVICES

Introduction: Thank you for visiting our online leasing application portal. We offer an equal housing opportunity at our communities. We do not discriminate based on race, color, religion, sex, handicap, familial status, national origin or other protected status. We do have specific qualification requirements, such as a credit score and background check to qualify for a leasing opportunity at our communities. For more details, please read below or contact the property manager directly at the location that you are applying for. You agree that your use of this portal and the online leasing service (collectively the Service) is entirely at your own risk.

Offer: This information contained in the Service is not an offer to be accepted. Completing the application is an offer to Landlord to rent the specified unit that the application is submitted for.

The application fee is $75. It is non-refundable.

Floor Plans: The floor plans are conceptual only. Floor plans are not exact replicas in size, shape or ratio. No promise is made with respect to measurements or square footage provided. Square footage and/or room dimensions are approximations and will vary between individual living units. We disclaim any damage loss or other consequence related to any misinterpretation of size or square footage of a living unit.

Rent: Quoted rent is per month only for new move-ins, based on the move-in date provided. Quoted rent for a living unit does not include other fees and charges that may be part of your lease. Quoted rent is subject to change without notice. If you sign a lease and the move-in date commences on a day other than the first day of the month, you will be charged a per diem rate of the base rent for the first partial month of occupancy.

Special Offer: Special offers quoted in the Service are limited in time, quantity and scope at the full discretion of management. A special offer must exist at the time of application submission for eligibility . To qualify for a special offer, you may be required to enter into a specific lease term length or satisfy other conditions. Special offers are subject to change without notice. Special: Free Month shall mean that an applicant that executes a lease and meets all other leasing requirements at the time for a unit that the special offer is noted in the Service will receive the first month of the 13 month lease term without a charge for the base rent. Landlord reserves the right to terminate this offer at any time prior to an application being submitted for the living unit that the offer is associated within the Service. Tenant must sign the appropriate addendum noting that this sum is refundable to Landlord if Tenant breaches the terms of the lease.

Personal Information: Your account is personal to you. You commit to keep your password confidential and agree not to share, communicate or transfer the password to any other individual or entity unless you accept responsibility for providing access to your personal information to that individual or entity. You acknowledge that sharing of an account or password provides another with access to any and all personal information that you have provided in your application. We are not responsible for the loss or theft of any information when passwords are shared, communicated or in any other way transferred to another. You recognize and accept being solely responsible for use of your password and account. You accept being held solely accountable for all consequences and obligations generated by the use of your password and account by a third party. If you are completing an application on line, all persons completing the on line application for the same living unit will have access to one anothers personal information entered on to the Service. Each application shares one password. If you should choose not to share personal information with the other applicants, you and other applicants will need to apply in person.

Availability: Living units listed as available are only available until someone has submitted an application for the living unit. Applications are taken on a first come basis for specific living units. No promise or guaranty is made that any unit will be available at the time of application submission. Submission means a completed application is supplied to us. An application is not considered complete and will not be processed without all individuals 18 years or older submitting an application for processing. If all individuals for an individual living unit do not provide completed applications within 48 hours of submission of on-line application, the deposit will be forfeited and the unit reservation will be released. Applications are offers and individual to specific living units. Countersigning of the lease by the Landlord is the acceptance of any offer made.

Reservation of a Unit: Living units are reserved upon the receipt of a completed application and remain reserved until an application is approved or denied. Upon denial of an application for any reason a living unit is relisted as available. Upon approval of an application, applicant has three (3) days to complete the lease and the other application requirements to preserve the reservation of the living unit. Failure to sign the lease provided, pay deposits and execute other required documents in a timely fashion will result in the release of the reservation of the living unit and availability in the Service.

Vehicles: Information provided about vehicles does not prevent towing or charges being assessed for improper parking on building property. Communities require a separate agreement for parking privileges. Fees for parking privileges vary between communities. Parking availability is not guaranteed. Parking if available at a building is operated by an independent provider and tenant is responsible for contracting with the parking authority for parking privileges.

Pets: In pet-friendly communities, residents are permitted to house ONE pet which meets the specifications that Landlord in its sole discretion prescribes. There are additional fees for housing a pet. Specific types of pets and breeds of dogs are not permitted. Landlord does not permit the housing or maintaining of any dog breed that is considered vicious (such as Pitbulls, Rottwillers, Doberman Pinschers, Bull Mastiffs and German Shepherds), any undomesticated animals, or any other dangerous or harmful animals or reptiles. Landlord reserves the right to deny the housing of any animal in it sole and absolute discretion. Other Costs: Other costs may be associated with signing of the lease, move in or amenities for certain properties. Please contact the property manager for more specific details relating to additional costs. All units require a security deposit equal to one and one-half months base rent.

Application Submission: Submission of an application for a living unit is certification that the information provided is correct and as accurate as possible. Submission of an application for a living unit is authorization for us to contact any references that have been listed. Submission of an application for a living unit is also authorization for us to obtain a consumer credit report (which may appear as an inquiry on your file) and a criminal background check.

Legally Capable To Enter A Lease: Leases are reserved for persons lawfully capable or authorized to be part of the rental contract in the United States. Anyone that completes an application and signs a lease must be at least 18 years of age. By using Services, you agree that you are legally capable of entering a lease and representing your proper identity. We reserve the right to refuse to allow your continued use of the Service for any reason, without notice if we determine, a violation of the terms and conditions, we are unable to identify, verify or authenticate any information provided, we discover false statements in your application, we perceive any diffusion, disbursement or other inappropriate use of confidential, illegal or offensive content or any other improper use of our system.

Email Communication: Registration and submission of an application requires you to provide a valid email address that will be used to communicate between you and us. All email communications being sent by us to the email address provided is understood as having been received by you. The date an email is sent shall be date of transmission for counting purposes. Confirmation of receipt of an application is received via email. If you do not receive a confirmation email, contact info@harrisonstn.com.

Intellectual Property: All images, graphs, text or other content contained in the Service are, to the fullest extent permitted by law, copyrighted and otherwise proprietary. No reproduction, transmission, modification, tampering or other use of this information is permitted without our prior written permission. We authorize you to view, download, print and store selected portions of the content of the Service provided that you only use such content for your own personal, non-commercial use.

Reservation of Rights: Applied reserves the right, without any limits or restrictions and at its sole discretion, to modify in whole or in part and at any time, these terms and conditions, the portal and the online leasing services. All changes will be effective once published on the portal. Use of the Portal and online leasing services after these changes have been published constitutes your acceptance of the modified terms and conditions. We reserve the right to modify, interrupt, or end at any time any service, without taking responsibility for the consequences resulting from these modifications, interruptions or ending of these services.

Disclaimer: You agree that your use of the Service is entirely at your own risk. The Service is provided on an as is or as available basis, without any warranties of any kind. All express and implied warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, we disclaim any warranties for viruses or other harmful components in connection with Service. Under no circumstances shall we be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if we have been advised of the possibility of such damages), resulting from your use of the Service, or resulting from any rental agreement, whether the damages arise from use or misuse of the Service, from inability to use the Service, or the interruption, suspension, modification, alteration, or termination of the Service. Such limitation shall also apply with respect to damages inferred by reason of amenities at respective properties offered or not offered in connection with the property.

Governed by NJ Law: This Service, the use thereof, and the leasing of a living unit, is governed by and construed in accordance with the domestic laws of the State of New Jersey without giving effect to any choice or conflict of laws provision or rule (whether of the State of New Jersey or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of New Jersey.
